Under federal special education law, if you have an impartial hearing and either side does not agree with the hearing officer’s decision, there is a right to appeal to the State Review Office, which is under the New York State Education Department (NYSED). NYSED is generally required to issue a decision in response to that appeal within 30 days. NYSED is not in compliance with this timeline and has asked the U.S. Department of Education to give them three years to fix the problem.
The U.S. Department of Education will be holding a hearing to gather input from the public on whether to grant this request. Parents of students with disabilities, school staff, service providers, and other stakeholders are invited to testify regarding NYSED's ability to come into compliance with the 30-day timeline for deciding impartial hearing appeals.
